William Witt and John Witt (Indenture)

This indenture made this tenth day of Aug in the year of our Lord Christ One thousand seven hundred forty one between William Witt of Goochland County of the one part and John Witt one of his the Said William Witt. Sons of the same County of the other part Witnesseth that the said Wm Witt for and in consideration he beareth toward John With his said Son as also divers others good Causes and Considerations want this Present especially waving hath given granted and Confirmed and by these Presents doth give grant and confirm to my said son John Witt one certain track or parsel of land containing two hundred acres lying and being on the north side of the north fork of James River in the said county and being the land whereon I now live & bounded as followeth (to wit) beginning at the Sickamore on the river thence & up the river according to the water corse to the mouth of a gut & corner red oak thence back to a corner red oak thence down to a corner white oak on Ballenger Creek thence to the beginning on the river together with all houses gardens orchards fields pastures meadow swamps – marshes woods ways waters courses with all priviledges & Roalties of hawking hunting fishing and fowling together with all and all manner of farther and other profits Commodities and advantages whatsoever to the same or any part thereof belonging or in wise appertaining TO HAVE AND TO HOLD the said Land & all Singular the Premisses with the Appurtenenes and every part and parsell thereof unto my said Son John Witt his heirs and assigns forever. And the said William witt his heirs and Assigns the said mentioned granted premisses and every part thereof with the Appurtenences unto my said Son John Witt his heirs and assigns against him the said William Witt his heirs and against all and every other Person and Persons whatsoever shall and will warrant and forever defend by these presents. And the said William Witt for himself his heirs and assigns doth Covenant and grant to and with his said Son John Witt his heirs and assigns & with every of them by these presents that if the State of the premises be not Effectually Conveyed from him by force of this grant to his said Son John Witt shall and will at any time hereafter within the Space of Seven years upon request of my said Son his heirs or assigns do make levy and acknowledge such and suffer or cause and presure to be done all such further assurances & acts in Law for the better assuring the said premises herein mentioned or Indented to be hereby granted and Confirmed unto my said Son John Witt his heirs and assigns according to Purport true intent and meaning of these Presents in Witness whereof the said Wm Witt hath hereunto Set his hand & Seal this day & year first above written.

Memorandum. That on the tenth day of Aug. in the year of our Lord Christ one thousand seven hundred and forty one full and peacable possesion and of all and Singular the Lands tenements & Hereditaments within granted or mentioned to be granted was delivered by the within named William Witt the father unto the within named John Witt the Son to hold to him the said John Witt the Son his heirs & assigns for ever according to the form & effect within written in the presents of Jos. Thompson, John Barnet, William Barnet.

At a Court held for Goochland County September 15th 1741. William Witt Acknowledged this Deed with the Livery of Seizin endorsd to be his Act and Deed which was Ordered to be Recorded.
